Terms of Service

1. The service

kazily is a subscription recruitment ATS: kanban pipeline, AI-assisted JD scoring, self-interviews, client portal, job-board syndication, stage-feedback automation and reporting. These Terms of Service govern your agency workspace subscription — the agreement between GRSL Recruitment Ltd ("kazily") and the recruitment agency or employer that opens a workspace ("you", "the Agency").

2. Plans, seats and billing

• Yearly billing gives two months free (pay for 10, get 12).
• Mid-cycle changes are prorated. Upgrading mid-month charges only the remaining days at the new rate; downgrades credit the difference to the next invoice. Each change generates an updated receipt.
• Receipts & tax invoices. Every payment produces a payment receipt and a KRA-compliant tax invoice, emailed automatically to your billing contact.
• Seat limits are enforced. Admins add users up to the plan's seat count; inviting beyond it requires an upgrade (prorated as above).
• Nonprofits registered in Kenya receive 50% off any paid plan — verification required.

3. Trials, cancellation and refunds

• The Free plan needs no card. Paid plans bill monthly or yearly in advance via M-Pesa or card.
• Cancel any time from the platform admin; service runs to the end of the paid period. We refund the unused portion of yearly plans on a prorated basis within 14 days.
• On cancellation you get 30 days to export your data (CSV/JSON) before the workspace is archived, then deleted after 90 days.

4. Your responsibilities

• You are the data controller for your candidates. You must have a lawful basis (usually consent collected at application) for the candidate data you upload, including CVs added directly by recruiters.
• Keep feedback respectful and lawful. Our 24h/48h automated feedback templates are a starting point — you own the words you send.
• Don't publish discriminatory job criteria; gate-keeping questions must relate to bona fide occupational requirements under Kenyan employment law.
• One accountable owner per published role; keep user accounts individual (no shared logins).

5. Our responsibilities

• Uptime: 99.5% monthly target, excluding notified maintenance windows.
• Support: email support on all plans; Growth and Custom get priority queues and a named contact.
• Security & processing: as described in the Data Processing Agreement, which forms part of these terms.
• No lock-in: full data export available self-serve at any time.

6. Acceptable use

You may not: scrape or resell the service, upload data you have no right to process, probe or test our infrastructure without written permission, send spam through the messaging tools, or misrepresent kazily as your own product except under a Custom white-label agreement.

7. Liability

kazily is provided "as is" with the warranties above. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. We are not liable for hiring decisions — AI match scores are advisory; humans decide. Nothing excludes liability that Kenyan law says cannot be excluded.

8. Governing law

These terms are governed by the laws of Kenya. Disputes go first to good-faith negotiation, then to the courts of Nairobi.
